EXTRACT
OF RESOLUTION:
Applications to Council for the conversion into strata lots of a
previously occupied residential building by an owner developer shall
meet the following criteria:
1.
Buildings shall be in substantial compliance with all current applicable
City Bylaws, Building and Fire Codes to the satisfaction of
the Building
Inspector.
2. The
applicant shall provide, at their expense, a report prepared by a
professional Architect or Engineer registered in the Province
of British
Columbia, confirming the projected life expectancy of the
building, the
building is structurally sound and complies with all current
applicable
bylaws and codes, to the satisfaction of the building
inspector. Any
deficiencies identified in the report shall be rectified
prior to conversion
being further contemplated. This provision may not be
required for units
up to and including four-plexes.
3. Strata
Title Conversions will be considered when the rental vacancy rate
in the City, as determined by CMHC, is greater than 3% for a
minimum of
twelve consecutive months prior to the proposed conversion.
This
provision shall not apply to units up to and including four-plexes.
4. The
applicant must satisfy the City that all tenants have been notified of
the owners application for Strata Conversion and no less than
60% of the
tenants are in favour of the conversion. This provision shall
not apply to
units up to and including four-plexes.
5.
Written approval from all applicable Utility Companies shall accompany
the application.
6. The
fees shall be in accordance with "City of Revelstoke Development
Application Bylaw #1513.
7.
Approval may be granted for a period of no more than 180 days from the
date of Councils approval. A new application will be required
if the strata
is not completed in the required period.
Concurrent with the foregoing, pursuant to Section 9 (3) of the
Condominium Act, "The approving authority (Council) shall consider, in
making its decision.

the
priority of rental accommodation over privately owned housing in the
area.
-
the
proposals of the owner developer for the relocation of persons
occupying the building.

the
life expectancy of the building; and
-
projected major increases in maintenance costs due to the conditions
of the building.
It may
consider any other matters that, in its opinion, are relevant."
Council
may approve the strata plan, refuse to approve the strata plan, or
refuse to approve the strata plan until all terms and conditions have
been met.
