Encroachments onto Grizzly Plaza sidewalks to provide seating for
outdoor eating areas.
Encroachments
on Grizzly Plaza Sidewalks
EXTRACT OF RESOLUTION:
"THAT Council hereby establishes a policy whereby all encroachment onto
Grizzly Plaza sidewalks for outdoor eating areas must fulfill the
following requirements:
Proof of
minimum of $1,000,000 liability insurance shall be required with
the City named
as co-insured (copy of Policy to City). Applicant shall ensure
liability is adequate.
All
encroachments require an Encroachment Agreement obtained from the City
of Revelstoke Building/Bylaw Department.
All
encroachments shall be limited to the maximum width of the business,
and be located immediately adjacent to the building.
All
encroachments shall be located so that a minimum 1.5 metres (5 feet)
walkway is maintained and that a minimum of 2.92 metres (9.6 feet)
from the encroachment to the curb is achieved.
All encroachment
areas shall be defined by portable fencing approved by the City
Building/Bylaw Department.
All
encroachments to be weighted sufficiently to prevent wind uplift.
All encroachment
areas to have sealed garbage containers.
The placement of
outdoor furniture will only be allowed during the hours of 8:00 a.m.
to 11:00 p.m. Additional time may be approved by the City.
The placement of
semi-permanent encroachments may be considered subject to the approval
from the Building and Bylaw and Public Works Departments.
Encroachment
areas cannot be subleased to other parties.
Annual permit
fee of $200.00 complete with proof of liability and a detailed site
plan will be required at the time of permit and renewal.
Failure to
comply with above noted requirements shall result in revocation of
permit."
