CITY OF REVELSTOKE

BYLAW No. 1854

Being a Bylaw to Amend Zoning Bylaw No. 1264, 1984
___________________________________________________________________

WHEREAS the Council of the City of Revelstoke deems it necessary to amend City of Revelstoke Zoning Bylaw No. 1264, 1984 to provide for the development of the Revelstoke Mountain Resort in accordance with the official community plan as amended;

AND WHEREAS the Council has determined that housing whose occupancy is restricted to resort employees, as defined in the bylaw amendments effected by this Bylaw, will be more affordable to those employees than housing whose occupancy is not restricted in that manner;

AND WHEREAS by resolution dated the 8th day of December, 2006 the Columbia Shuswap Regional District consented under s.13 of the Community Charter to the exercise of the Council’s powers in relation to planning and land use management, in that portion of Electoral Area B of the Regional District to which this Bylaw applies;

AND WHEREAS a public hearing on this Bylaw was held on January 8th, 2007;

NOW THEREFORE the Council of the City of Revelstoke, in open meeting assembled, enacts as follows:

1. Zoning Bylaw No. 1264, 1984 is amended by deleting from SCHEDULE B the definitions of “DORMITORY UNIT” and “HOTEL” and adding to SCHEDULE B the following definitions in appropriate alphabetical order:

BED AND BREAKFAST means the licensed use of a detached dwelling by a resident of the dwelling for the provision of temporary lodging of paying guests in not more than four guest rooms in the dwelling and the serving of a morning meal to such guests, and includes the use of common living and dining areas in the dwelling by such guests.

CAFÉ means a small restaurant limited to the serving of beverages, snacks and light meals.

EMERGENCY HEALTH SERVICES FACILITIES means facilities providing immediate, interim medical care, including but not limited to ambulance stations and first aid posts.

HELI-SKI FACILITIES means a building containing facilities for the use of passengers using helicopters to access ski trails or areas such as personal lockers, change rooms, lounges, and restaurants, and does not include facilities for fueling, maintenance, repair or storage of helicopters.

HELIPAD means a constructed pad or other area designated for use as a helicopter landing area and used for the purpose of picking up and discharging passengers or cargo, and does not include facilities for fueling, maintenance, repair or storage of helicopters.

HOSTEL means a building used as a temporary place of lodging containing one or more dormitories, and containing common washroom facilities and common areas for preparing and eating meals.

HOTEL means a building used exclusively for the temporary lodging of the general public in rooms or suites which may have kitchen facilities, wherein payment for occupancy is on a daily or weekly basis, and which contains a lobby and a restaurant or public dining room and may also contain licensed beverage facilities, banquet rooms, retail stores, personal services uses, and indoor recreation, entertainment and conference facilities.

LODGE means a hotel without a restaurant or public dining room.

NEIGHBOURHOOD PUB means a liquor primary licensed establishment licensed as such under the Liquor Control and Licensing Act with or without restaurant facilities.

RESORT EMPLOYEE means an individual either employed or self-employed in the CD-8 zone, and includes, for a period not exceeding 6 months, an individual who has ceased employment or self-employment in the CD-8 zone after having been so employed or self-employed for at least five of the six years prior to ceasing employment.

RESORT EMPLOYEE HOUSING UNITS means housing located in the City of Revelstoke that is charged by a covenant under s.219 of the Land Title Act in favour of the City of Revelstoke and subject to a housing agreement between the owner and the City of Revelstoke under s.905 of the Local Government Act, each of which restricts the occupancy of the unit to a resort employee and individuals related to the resort employee by blood, adoption, foster parenthood, or marriage, including common law marriage, and cohabiting with the resort employee in a single household.

SKI LIFTS means chair lifts, surface lifts, gondolas or cable cars provided for the purpose of transporting people to designated areas or trails for downhill skiing, cross-country skiing, snowshoeing, cycling or hiking.

2. Zoning Bylaw No. 1264, 1984 is further amended by adding as Section 11A.8 the zone regulations attached to this Bylaw as Schedule A.

3. Zoning Bylaw No. 1264, 1984 is further amended by adding as Schedule A1 the map attached to this Bylaw as Schedule B.

4. The Official Zoning Atlas, being Schedule A of Zoning Bylaw No. 1264, is amended by designating the area of land outlined in heavy black line on Schedule C to this Bylaw as CD-8 (Comprehensive Development 8 Zone) and making such consequential changes to the Zoning Atlas as are required to illustrate the zoning of the land.

5. Section 11A.8.4(3) as added to Zoning Bylaw No. 1264 by this Bylaw is not severable from the other provisions of section 11A.8. In the event that a court of competent jurisdiction determines that section 11A.8.4(3) is invalid, that provision shall not be severed from the other provisions, it being the Council’s intention in such circumstances that the effect of this Bylaw be reversed and that the provisions of Zoning Bylaw No. 1264 applicable to the lands in the CD-8 zone prior to the adoption of this Bylaw again apply to the lands.

6. This Bylaw also amends Rural Revelstoke Land Use Bylaw No. 2200 to the extent that such bylaw applies to the land described in Section 4.

7. This Bylaw may be cited for all purposes as the “City of Revelstoke Zoning Amendment Bylaw No.1854”.

8. This bylaw comes into force on the date of adoption in relation to land within the City of Revelstoke, and on February 15th, 2007 in relation to land outside the City.
