CITY OF REVELSTOKE

BYLAW No. 1835

Being a Bylaw to Amend Zoning Bylaw No. 1264, 1984
___________________________________________________________________

WHEREAS the Council of the City of Revelstoke, Province of British Columbia, deem it necessary to amend the City of Revelstoke Zoning Bylaw No. 1264, 1984 to provide for the establishment of a Comprehensive Development Zone 11A (CD-11)

NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia, in open meeting assembled, enacts as follows:

1. THAT Bylaw No. 1264, 1984 be amended by adding thereto a new section 11A as follows:

11A Comprehensive Development Zone (CD-11)

11A.11 Intent

The Intent of this zone is to provide for a multi-family residential development.

11A.11.1 Uses Permitted

The following uses, and no others, are permitted:

1) Apartment building
2) Accessory uses

11A.11.2 Conditions of Uses

The following guidelines apply to the use of all land and structures within the CD-11 zone

1) The apartment building shall contain no more than 8 units.
2) Each individual garage and storage area shall be associated with an individual dwelling unit within the building for the unit resident or owner’s exclusive personal use.
3) All landscaping areas depicted in Schedule A shall be provided in accordance with a Landscaping Plan submitted to and approved by the Director of Planning. The Landscaping Plan shall contain adequate measures to maintain the landscaping provided.
4) All development shall reflect a high quality of design in accordance to the guidelines contained within Development Permit Area D-2 (Townley Street Linkage).

11A.11.3 Height of Building

The height of a building shall not exceed 9 metres (29.5 feet) nor two storeys.

11.A.11.4 Minimum Yard Requirements

1) A front and rear yard shall be provided of not less than 6 metres (19.7 feet) each in depth.
2) a minimum side yard on one side of not less than 1.21 metres (4 feet) in depth and a total of both side yards to be not less than 4.26 metres (14 feet).

11A11.5 Floor Area Ratio

The maximum floor area ratio shall be 0.8.

11A.11.6 Parking

All parking stalls to be provided in accordance to the multi-family dwelling requirements as prescribed in Section 12 of the City of Revelstoke Zoning Bylaw 1264, 1984 as amended from time to time.

11A.11.7 Plan to be Part of Bylaw

All buildings, structures, and uses will be in substantial compliance with the size, shape and siting as depicted on the approved comprehensive development plan which shall be attached to, and form part of, this bylaw as Schedule A.

2. THAT Page 20 of the Official Zoning Atlas, being Schedule A of the City of Revelstoke Zoning Bylaw No. 1264, be amended by changing the zoning of Parcel “B” (LA99479)
Block 20 Section 34 & 35 Township 23 Range 2 W6M Kootenay District Plan 636K
from Highway Commercial (C-4) and Fringe Area Service Commercial (C-12) to Comprehensive Development Zone CD-11.

3. THAT this Bylaw may be cited for all purposes as the “City of Revelstoke Zoning Amendment Bylaw No. 1835”.

4. THAT this bylaw shall take affect upon the date of its adoption by City Council.
