CITY OF REVELSTOKE

BYLAW No. 1817

Being a Bylaw to Amend Zoning Bylaw No. 1264, 1984
___________________________________________________________________

WHEREAS the Council of the City of Revelstoke, Province of British Columbia, deem it necessary to amend the City of Revelstoke Zoning Bylaw No. 1264, 1984 to provide amendments to the following: “Definitions”, “Basic Provisions” and “Supplementary Regulations”.

NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia in open meeting assembled enacts as follows:

1. THAT Schedule B be amended to include the following definitions:

DEVELOPMENT means any of the following associated with or resulting from the local government regulation or approval of residential, commercial or industrial activities or ancillary activities to the extent that they are subject to local government powers under Part 26 of the Local Government Act:
(a) removal, alteration, disruption or destruction of vegetation:
(b) disturbance of soils;
(c) construction or erection of buildings and structures;
(d) creation of nonstructural impervious or semi-impervious surfaces;
(e) flood protection works;
(f) construction of roads, trails, docks, wharves and bridges;
(g) provision and maintenance of sewer and water services;
(h) development of drainage systems;
(i) development of utility corridors;
(j) subdivision as defined in section 872 of the Local Government Act;

RIPARIAN AREAS REGULATION B.C. Reg. 376/2004 (RAR) means regulations established to protect riparian areas from development so that the areas can provide natural features, functions and conditions that support fish life processes.

STREAM includes any of the following that provides fish habitat:
(a) a watercourse, whether it usually contains water or not;
(b) a pond, lake, river, creek or brook;
(c) a ditch, spring or wetland that is connected by surface flow to something referred to in paragraph (a) or (b);

2. THAT Section 4 – Basic Provisions be amended to include the following:

4.7 Siting Development Adjacent to Watercourses and Streams

Where development is being proposed adjacent to a watercourse or stream, Section 4 of the Riparian Areas Regulation must be adhered to.

3. THAT Section 5.2 Location and Siting of Buildings to be amended to include the following:

(3) Where location and siting of buildings on lands is proposed adjacent to a watercourse or stream Section 4 of the Riparian Areas Regulations must be adhered to.

4. THAT a Public Hearing was held pursuant to Sections 890 and 892 of the Local Government Act.

5. THAT this Bylaw may be cited for all purposes as the “City of Revelstoke Zoning Amendment Bylaw No. 1817”.

6. THAT this Bylaw shall take effect upon the date of it’s adoption by Council.

PUBLIC HEARING HELD THIS 14th DAY OF MAY, 2007.

READ A THIRD TIME THIS 14th DAY OF MAY, 2007.

ADOPTED BY CITY COUNCIL THIS 14th DAY OF MAY, 2007.
