CITY OF REVELSTOKE

BYLAW No. 1799

Being a Bylaw to Amend Zoning Bylaw No. 1264, 1984
___________________________________________________________________

WHEREAS the Council of the City of Revelstoke, Province of British Columbia, deem it necessary to amend the City of Revelstoke Zoning Bylaw No. 1264, 1984 to provide for amendments to permitted uses in certain Residential Districts.

NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia in open meeting assembled enacts as follows:

1. THAT Section 7.2.1(4) and 7.3.1(4) be deleted in their entirety and replaced as follows:

(4) Living accommodation in basements of single family dwellings, subject to the provisions of Section 5.9 of this Bylaw.

2. THAT Section 5.9 be deleted in its entirety and replaced as follows:

5.9 Secondary Suites

Notwithstanding the definition for a single family dwelling, accommodation below the storey on which housekeeping facilities are located may include an additional housekeeping facility which may be rented provided that:

(1) no additional housekeeping facilities or secondary suites shall be permitted in the R1 Single Family Residential District.

(2) the accommodation is furnished with a separate entrance with appropriate lighting

(3) the finished surfaces of the ceiling and floor are nowhere less than 2.2 metres (7.3 feet) apart.

(4) one off-street parking space is provided for each basement suite.

(5) the additional housekeeping facility is constructed to the standards contained in the BC Building Code: Section 9.36 – Secondary Suites.

3. THAT Section 12.7 (1) be deleted in its entirety and replaced as follows:

(1) No parking area shall be located within a required front yard, except:

(a) in an R1, R2 or R2A Zoning District, or

(b) i) in a C4, C6, C7, C8 or M District, where parking
may be located in a required front yard subject to the conditions that any parking area shall be separated from an adjoining street or from a directly abutting lot in an R District by a fully landscaped strip of not less than 2 metres (6.6 feet) in width.

ii) for the C8 District, parking shall be permitted in the
front yard setback only if the area is paved and provided with appropriate drainage.

4. THAT the general terms and conditions of this Bylaw have been advertised as required by Section 893 (2) of the Local Government Act.

5. THAT a Public Hearing was held pursuant to Sections 890 and 892 of the Local Government Act.

6. THAT this Bylaw may be cited for all purposes as the “City of Revelstoke Zoning Amendment Bylaw No. 1799”.

7. THAT this Bylaw shall take effect upon the date of its adoption by Council.
