CITY OF REVELSTOKE

BYLAW No. 1786

Being a Bylaw to Amend Zoning Bylaw No. 1264, 1984
___________________________________________________________________

WHEREAS the Council of the City of Revelstoke, Province of British Columbia, deem it necessary to amend the City of Revelstoke Zoning Bylaw No. 1264, 1984 to provide for the establishment of an Airport District – A1 and an Airport Industrial District – A2.

NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia in open meeting assembled enacts as follows:

1. THAT Bylaw No. 1264, 1984 be amended by adding thereto a new Section 11B as follows:

Section 11B – Airport District – A1

11B.1 AIRPORT DISTRICT – A1

The intent of this district is to provide for the operation of an airport or heliport.

11B.1.1 Uses Permitted

(1) The following uses:

(a) Airports and heliports, including all uses, structures and services customarily associated therewith, including:

i) Aircraft take-off and landing,
ii) Aircraft hangars,
iii) Aircraft storage and maintenance,
iv) Aircraft fuel storage and sale,
v) Airport administrative offices,
vi) Airport terminal including facilities for the processing of people and goods for trans-shipment by air and auxiliary commercial activities contained with the terminal building.

11B.1.2 Conditions of Use

Notwithstanding any provisions of this Bylaw, the location of all buildings, structures, facilities or any other use shall conform to the requirements of Transport Canada.

Heliports are to be provided with effective and/or adequate noise screening.

11B.1.3 Lot Area

Each lot shall have an area of not less than 2.0 hectares (4.9 acres).

11B.1.4 Lot Coverage

The maximum coverage shall be 10 percent of the lot area.

11B.1.5 Height of Buildings

The height of a building or structure shall not exceed 12 metres (39.4 ft).


11B.1.6 Minimum Setback Requirements

(1) No part of any building shall be closer than 40 meters to the centre line of a controlled access highway designated pursuant to Section 3 of the Controlled Access Highways Act, no closer than 15 meters to the centre line of any other highway, except that in no case shall a building be closer to the boundary of said highway than permitted pursuant to Section 43 of the Highway Act.

(2) No part of any building shall be closer than 10 meters to any site boundary other than the common boundary with a highway.

11B.1.7 Off-Street Parking and Loading

Off-street parking and loading shall be provided and maintained in accordance with Section 12 and 13 of this Bylaw, respectively.

11B.1.8 Other Regulations

For further regulations, which apply to lots within the Airport District – A-1, refer to:

Section 4 - Basic Provisions
Section 5 - Supplementary Regulations
Section 6 - Development Permits.

Section 11B – Airport Industrial District – A2

11B.2 AIRPORT INDUSTRIAL DISTRICT – A2

The intent of this district is to provide for airport related or dependent uses.

11B.2.1 Uses Permitted

(1) The following uses:

(a) Industrial activities associated with aircraft and airports and shall include the following, or similar, activities:

(i) Manufacture, sale, service and storage of aircraft and aircraft parts;
(ii) Storage of goods and materials awaiting trans-shipment by air;
(iii) Commercial, charter or private airline;
(iv) Flying school;
(v) Federal, Provincial and Municipal government operations.

11B.2.2 Conditions of Use

Notwithstanding any provisions of this Bylaw, the location of all buildings, structures, facilities or any other use shall conform to the requirements of Transport Canada.

Heliports are to be provided with effective and/or adequate noise screening.

11B.2.3 Lot Area

Each lot shall have an area of not less than 930m 2 (10010ft 2)

11B.2.4 Lot Coverage

The maximum coverage shall be 50 percent of the lot area.

11B.2.5 Height of Buildings

The height of a building or structure shall not exceed 12 metres (39.4 ft).
11B.2.6 Minimum Yard Requirements

(1) A front yard shall be provided of not less than 6 meters (l9.7 ft.) in depth except where a lot is separated from a lot in a "R" District by a street (being less than 80 ft. in width), such front yard shall not be less than l0 meters (32.8 ft.) in depth.

(2) A side yard shall be provided on each side of the building of not less than 3 meters (9.8 ft) in width, except that:

(a) a side yard not flanked by a street, lane, or an R District may be reduced to nil, provided that the other side yard has a width of not less than 6 meters (19.7 ft).

(b) where a lot abuts a lot in an R District, or is separated by a street or lane therefrom, a side yard shall be provided of not less than 10 meters (32.8 ft) in width.

(3) A rear yard shall be provided of not less than 3 meters (9.8 ft) in depth except where a lot abuts a lot in an R District or is separated by a lane therefrom, each rear yard shall be not less than 10 meters (32.8 ft) in depth.

11B.2.7 Off-Street Parking and Loading

Off-street parking and loading shall be provided and maintained in accordance with Section 12 and 13 of this Bylaw, respectively.

11B.2.8 Other Regulations

For further regulations, which apply to lots within the Airport Industrial District – A2, refer to:

Section 4 - Basic Provisions
Section 5 - Supplementary Regulations
Section 6 - Development Permits.

2. THAT a Public Hearing was held pursuant to Sections 890 and 892 of the Local Government Act.

3. THAT this Bylaw may be cited for all purposes as the “City of Revelstoke Zoning Amendment Bylaw No. 1786”.

4. THAT this Bylaw shall take effect upon the date of it’s adoption by Council.
