WHEREAS the Council of the City of Revelstoke, Province of British Columbia, deem it necessary to amend the City of Revelstoke Zoning Bylaw No. 1264, 1984 to provide for an amendment to the permitted uses for Institutional Districts and to amend the Accessory Building provisions contained within this Bylaw.

NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia in open meeting assembled enacts as follows:

1. THAT Section 10.3.1 be amended to include the following as a permitted use:

“(7) Accessory buildings and structures subject to the regulations of Section 5.6 of this Bylaw.”

2. THAT Section 5.6 be amended to delete the section title and replaced as follows:

“5.6 Accessory Buildings and Structures ”

3. THAT Section 5.6 be amended to include the following:

“5.6(4) Institutional Districts

(a) The regulations governing accessory buildings and structures shall conform to the provisions contained in Section 5.6(2) (a) through (i).”

4. THAT Section 5.6(2) (h) (i) and (ii) be deleted in their entirety and replaced as follows:

“(h) (i) An accessory building in an R or P District shall be located not closer to the side street than the side yard setback prescribed for the principal building in the district in which it is located.

(ii) An accessory building in an R1, R2 or R2A District shall be located not closer than 1.2 metres (3.9 ft.) to the rear lot line, or 3 metres (9.8 ft.) for a P District when such rear lot line abuts the side yard of an adjacent lot in an R District.”

5. THAT the general terms and conditions of this Bylaw have been advertised as required by Section 893 (2) of the Local Government Act.

6. THAT a Public Hearing was held pursuant to Sections 890 and 892 of the Local Government Act.

7. THAT this Bylaw may be cited for all purposes as the “City of Revelstoke Zoning Amendment Bylaw No. 1723”.

8. THAT this Bylaw shall take effect upon the date of it’s adoption by Council.
