CITY OF REVELSTOKE
BYLAW No. 1659
Being a Bylaw to Amend Zoning Bylaw # 1264, 1984
WHEREAS the Council of the City of Revelstoke, Province of British Columbia, deem it necessary to amend the City of Revelstoke Zoning Bylaw #1264, 1984 to provide for the establishment of a Comprehensive Development Zone 5 (CD-05).
NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia, in open meeting assembled, enacts as follows:
1. THAT Bylaw No. 1264, 1984 be amended by adding thereto a new Section 11A as follows:
11A Comprehensive Development Zone 5 - (CD - 05)
11A.5 Intent
The intent of this zone is to provide for downtown commercial uses including buildings and structures suitable for licensing a neighbourhood public house pursuant to the Liquor Control and Licensing Act.
11A.5.1 Uses Permitted
The following principle uses, and no others are permitted:
(1) Business and professional offices. (2) Cafes and restaurants (excluding drive-in restaurants). (3) Clubs or lodges. (4) Funeral parlors. (5) Health service centres and clinics. (6) Libraries. (7) Personal service establishments, including: barber shops, beauty parlors, dry cleaning establishments, electrical appliance repair shops, florist shops, photographic studios, shoe repair shops, tailor shops and similar establishments. (8) Public houses pursuant to the Liquor Contract and Licensing Act, including: neighbourhood pubs, night clubs and beer and wine stores (9) Retail stores.
11A.5.2 Conditions of Use
The following guidelines apply to the use of all land and structures within the CD-05 zone:
(1) All development shall reflect a high quality of design and detail to reflect a historic character based on the Downtown Revitalization Guidelines.
(2) The building will be constructed in accordance to the approved Development Permit DP-2001-05.
(3) Signage will be in accordance to the approved Development Permit DP-2001-05.
(4) All outdoor storage and refuse containers shall be screened from public view.
11A.5.3 Height of Buildings
The following building height shall apply to all structures located on the site:
(1) The principal building is permitted to a maximum height of 12 metres above the natural ground level or two and a half storeys.
11A.5.4 Setbacks of Structures and Uses
(1) All buildings and structures shall be set back 3.0 metres from the property line on the rear yard. No setback is required for front or side yards.
11A.5.5 Site Servicing
The following site servicing shall apply to land and structures within this zone:
(1) All site servicing requirements, or upgrades including sanitary sewer works, water works and storm drainage works shall be provided in accordance with the standards set out within the City of Revelstoke Subdivision Control Bylaw No. 1270, 1984 and the Works and Services Bylaw No. 1555, 1997.
11A.5.6 Parking
(1) All parking shall be provided in compliance with the following requirements:
(a) Off-street parking and loading to be provided at a fifty percent ratio of the C-1 parking requirement as prescribed in Sections 12 and 15 of the City of Revelstoke Zoning Bylaw No. 1264:20 Stalls - Neighbourhood Pub 4 Stalls - Retail Commercial 1 Stall - Loading
(b) That the provision of one stall be reserved for handicapped parking and
(c) All parking lots and driveways shall be hard surfaced.
11A.5.7 Plan to be Part of Bylaw
All buildings, structures and uses will be in substantial compliance with the size, shape and siting as depicted on the approved comprehensive development plan which shall be attached to, and form part of, the bylaw as Schedule A through C.
2. THAT Page 15 of the Official Zoning Atlas, being Schedule A of Zoning Bylaw No. 1264, be amended by changing the zoning of P.I.D. 016-167-848 & 016-167-856 being Lots 26 & 27, Block 2, Section 34, Township 23, Range 2, W6M Kootenay District 636 from C-1 Central Business District to CD -05 Comprehensive Development Zone 5.
3. THAT this Bylaw may be cited to all purposes as the City of Revelstoke Zoning Amendment Bylaw No. 1659, 2001.
4. THAT this bylaw shall take effect upon the date of its' adoption by City Council.
