Being A Bylaw To Amend Zoning Bylaw #1264, 1984
_________________________________________________________________



WHEREAS the Council of the City of Revelstoke, Province of British Columbia, deem it necessary to amend the City of Revelstoke Zoning Bylaw #1264, 1984 as follows: (1) to redefine "Hotel", (2) add "Hotel" as a permitted use and, (3) allow for an apartment on a specific site, all within the Highway Commercial District (C4) zone.


NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia, in open meeting assembled, enacts as follows:


1. THAT "Section 8.4.1 Uses Permitted" be amended by deleting 8.4.1(1) and substituting the following:

8.4.1(1) Motels, motor hotels and hotels


2. THAT "Section 8.4.9 Special Regulations" be added as follows:

8.4.9 Special Regulations

Notwithstanding "Section 8.4.1 Uses Permitted", an apartment building is an additional permitted use on "the South Half of Villa Lot 11, Section 33, Township 23, Range 2, West of the 6th Meridian, Kootenay District, Plan 9551, Except Part included in Plan R257".

3. THAT "Schedule B - Definitions" of Zoning Bylaw #l264, 1984 be amended by deleting the definition of "Hotel" and substituting the following:

"Hotel" means a building in respect of every room or suite of rooms of which a registration certificate has been issued and is in force pursuant to s.3 of the Hotel Room Tax Act, which generally has inside access and provides the following services to transient members of the public:

1. accommodation;
2. a lobby and office with a guest register;
3. an attendant on duty at all times;
4. a public dining room or restaurant either through ownership, lease or management which may be detached but located on the same legal parcel, and

which may contain licensed beverage facilities, banquet rooms, convention facilities, full or partial kitchen facilities and various other personal services.


4. THAT a Public Hearing was held pursuant to Sections 956 and 957 of the Municipal Act.

5. THAT this Bylaw shall take effect upon the date of its' adoption by City Council.

6. THIS Bylaw shall be cited for all purposes as the "City of Revelstoke Zoning Amendment Bylaw #1532, 1996".
