CITY OF REVELSTOKE

BYLAW No. 1915

A Bylaw to Provide for the Determination of Various Procedures for the Conduct of Local Government Elections and Other Voting
___________________________________________________________________

WHEREAS under the Local Government Act, the Council may, by bylaw, determine various procedures and requirements to be applied to the conduct of local government elections and other voting;

AND WHEREAS Council wishes to establish voting procedures and requirements under that authority;

NOW THEREFORE, the Council of the City of Revelstoke, in open meeting assembled, enacts as follows:


1. CITATION

This Bylaw may be cited for all purposes as “General Local Government Election Bylaw No. 1915.”


2. DEFINITIONS

In this bylaw:

"ELECTOR" means a resident elector or non-resident property elector of the jurisdiction as defined under the Local Government Act.

"GENERAL VOTING DAY" for other voting means the date set under Section 162 of the Local Government Act.

"JURISDICTION" means, in relation to an election, the municipality for which it is held.

"OTHER VOTING" means voting on a matter referred to in Section 158 of the Local Government Act.


3. ADDITIONAL ADVANCE VOTING OPPORTUNITIES

(a) In addition to the required advance voting opportunity on the 10th day before general voting day, the following day is hereby established as advance voting opportunities for the general local election and other voting:

8th day before general voting day except when the 8th day before the general voting day falls on a statutory holiday, in which case the following day before general voting day.

(b) Advance voting opportunities on the days specified in subsection 3(a) shall be available between the hours of 8:00 am and 8:00 pm at the Revelstoke Community Centre located at 600 Campbell Avenue.



4. SPECIAL VOTING OPPORTUNITIES

(a) To give electors who may otherwise be unable to vote an opportunity to do so, the Council will provide a special voting opportunity as authorized under section 99 of the Local Government Act by establishing the following places as special voting places on general voting day for the general local election and other voting during the hours specified and for the electors specified:

(i) Herbert House
416 Leach Street
8:00 a.m. to 9:00 a.m.
Only electors who are residents may vote at this special voting opportunity.

(ii) Queen Victoria Hospital
1200 Newlands Road
9:15 a.m. to 10:00 a.m.
Only electors who are patients and residents at this location may vote at this special voting opportunity.

(iii) Mt. Cartier Court
1200 Newlands Road
10:15 a.m. to 12:00 noon
Only electors who are residents may vote at this special voting opportunity.

(iv) Moberly Manor
712 West Second Street
1:15 p.m. to 2:15 p.m.
Only electors who are residents may vote at this special voting opportunity.

(v) Monashee Court
505 West Third Street
2:30 p.m. to 4:30 p.m.
Only electors who are residents may vote at this special voting opportunity.

(vi) Mt. Begbie Manor
1214 Downie Street
6:00 p.m. to 7:45 p.m.
Only electors who are residents may vote at this special voting opportunity.

(b) The following procedures for voting and for conducting the voting proceedings apply to the special voting opportunities:

(i) Procedures for voting will be consistent with those set out in the Local Government Act except that for hospital patients only, bedside voting will be permitted. Upon receipt of ballots, the patient, screened from observation, will mark the ballots and then deposit them in the ballot box in use for this special voting opportunity. Electors unable to mark their ballots because of physical or other difficulties may be assisted in the manner provided for in the Local Government Act.


5. RESOLUTION OF TIE VOTE AFTER JUDICIAL RECOUNT

(a) In the event of a tie vote after a judicial recount, the tie vote will be resolved by conducting a lot in accordance with section 141 of the Local Government Act.



6. REPEAL OF BYLAW

That the City of Revelstoke Local Government Elections and other Voting Procedures Bylaw No. 1470, 1993 be repealed in its entirety.
