CITY OF REVELSTOKE BYLAW No. 1888 ___________________________________________________________________ Being a bylaw to establish a local service area for the purpose of providing sanitary sewer service for the benefit of the Clearview Heights (CPR Hill) Local Service Area ___________________________________________________________________ WHEREAS pursuant to the provisions in Part 7, Division 5 of the Community Charter, the Council of the City of Revelstoke is authorized by bylaw to undertake any work or service coming within the powers of the municipality for the benefit of a part of the municipality; AND WHEREAS the provisions of Section 212 of the Community Charter have been complied with; AND WHEREAS the capital cost of the sanitary sewer system is estimated to be $1,058,000. The contribution from City owned properties is $115,000 and the relocation of the existing sewer trunk on Track Street is $225,000. The net capital cost of the local service area is $718,000 which will be financed by the benefiting area. Now Therefore the Council of the City of Revelstoke, in open meeting assembled enacts as follows: Establishment of Local Service Area: 1. The portion of the City of Revelstoke, as shown outlined in bold on the plan attached as Schedule ’A’ forming part of this Bylaw, to be known as “Clearview Heights Local Service Area” shall be the benefiting area of the City of Revelstoke by the services hereinafter set forth. Authorization of Service: 2. The City of Revelstoke is authorized to provide, operate, maintain and to undertake and carry out, or cause to be carried out sanitary sewer service and to do all things necessary for the benefit of the Clearview Heights Local Service Area. Cost Recovery: 3. The entire costs of the service provided in the amount of $718,000, and including interest on borrowing to the City of Revelstoke, shall be borne by the owners of the land in the Clearview Heights Local Service Area and shall be raised by Council, and for that purpose the Council may levy and impose a parcel tax. Title: 4. This bylaw may be cited for all purposes as “Clearview Heights Local Service Area Bylaw No. 1888”. READ A FIRST TIME THIS 17th day of DECEMBER, 2007.
