BYLAW No. 1853

A Bylaw to Authorize the Delegation of Council Authority to Issue Development Permits Authorizing Development in the Revelstoke Mountain Resort Development Permit Area
___________________________________________________________________

WHEREAS the Community Charter allows a local government to delegate the powers, duties and functions of Council to a council member, council committee, officer, employee and to other bodies established by Council;

NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia in open meeting assembled enacts as follows:

Interpretation

1. In this Bylaw:

a) “Council” means the elected Council of the City of Revelstoke; and
b) “Act” means the Local Government Act.


Delegation of Authority and Persons Holding Position

2. The Council hereby delegates to the Director of Planning, his or her deputy, and any person acting with authorization in the capacity of the Director of Planning, the authority of the Council to issue development permits under the Act authorizing development in the Revelstoke Mountain Resort Development Permit Area.


Reconsideration of Decision by Council

3. An owner of property who is dissatisfied with the delegate decision is entitled to have the decision reconsidered by Council, in accordance with the following procedure:

a. the owner must apply for the reconsideration in writing giving reasons why the owner wishes the decision to be reconsidered by Council, delivered to the Chief Administrative Officer, within 30 days after the decision is communicated in writing to the owner;
b. the Chief Administrative Officer must place each request for reconsideration of the delegate’s decision on the agenda for a regular Council meeting;
c. Council must consider the material that was considered by the delegate in making the decision;
d. the owner or their agent is entitled to be heard by Council at the regular Council meeting; and
e. after having reconsidered the delegate’s decision Council may confirm, defer for additional information, amend or set aside the delegate’s decision, in the latter event substituting the decision of Council.

Severability

4. If any section, sub-section, sub-clause, or phrase of this bylaw is for any reason held to be invalid by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this bylaw.



Citation

5. This Bylaw may be cited as “City of Revelstoke Delegation Bylaw No. 1853”.
