BYLAW NO. 1721

Being a Bylaw to Dispose of a Certain Portion of a Public Highway In Exchange for Such Lands as are Necessary for the Purpose of Widening a Portion of Public Highway Commonly Known as Upper McKinnon Road

WHEREAS the Municipal Council may, by Bylaw, dispose of a portion of highway in exchange for land necessary for the purpose of improving, widening, straightening, relocating or diverting a highway;

AND WHEREAS it is deemed desirable to widen and improve a portion of Upper McKinnon Road;

NOW THEREFORE, the Council of the City of Revelstoke, in open meeting assembled hereby enacts as follows:

1. That the portion of public highway comprising approximately 524 square metres, and described as Part of Arrow Drive lying South of Lots A and B, Plan 14132, Section 23, Township 23, Range 2, West of the 6th Meridian, Kootenay District and shown as Parcel 2 (closed road) on Reference Plan prepared by W.E. Maddox, B.C.L.S. and completed by him on October 2, 2003, a copy of which is attached hereto as Schedule “A”, is hereby stopped up and closed to all traffic and cease to be public highway.

2. The City of Revelstoke is hereby authorized to convey to Martin Miertsch and Heidi Marie Miertsch that portion of public highway comprising approximately 524 square metres, and described as Part of Arrow Drive lying South of Lots A and B, Plan 14132, Section 23, Township 23, Range 2, West of the 6th Meridian, Kootenay District, as shown as Parcel 2 (closed road) on Reference Plan prepared by W.E. Maddox, B.C.L.S. and completed by him on October 2, 2003, a copy of which is attached hereto as Schedule “A”.

3. In exchange for the parcels of land aforesaid, the City of Revelstoke is hereby authorized to accept from Martin Miertsch and Heidi Marie Miertsch that portion of land comprising approximately 47 square metres, and described as Part of Lot B, Plan 14132, Section 23, Township 23, Range 2, West of the 6th Meridian, Kootenay District, shown as Parcel 1 (open road) on Schedule “A” attached hereto, which is hereby set apart and established as a public highway.

4. The Mayor and Director of Corporate Administration are hereby authorized to execute such conveyances, deeds, maps, plans, receipts and documents on behalf of the City of Revelstoke as may be necessary for the purposes aforesaid and to affix the Corporate Seal of the City of Revelstoke thereto.

5. The Council shall, before adopting this Bylaw, cause public notice of its intention to do so to be given by advertisement once each week for two consecutive weeks in a newspaper published or circulating in the City of Revelstoke.

6. This Bylaw may be cited for all purposes as the “City of Revelstoke Upper McKinnon Drive Road Exchange and Dedication Bylaw No. 1721”.

7. This Bylaw shall take effect upon the date of its adoption by City Council.

PUBLIC NOTICE OF INTENTION TO PROCEED ADVERTISED IN THE REVELSTOKE TIMES REVIEW ON THE 3rd DAY OF DECEMBER, 2003 AND ON THE 10th DAY OF DECEMBER, 2003.

ADOPTED THIS 12th DAY OF JANUARY, 2004.
