CITY OF REVELSTOKE
BYLAW NO. 1705

Being a Bylaw to authorize the alteration of a fence structure, bringing up to standards required by City of Revelstoke Zoning Bylaw No. 1264

WHEREAS the Council of the City of Revelstoke, Province of British Columbia deem it necessary to authorize, by Bylaw, the alteration by removal of a portion of prohibited over height fence.
NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia, in open meeting assembled, pursuant to Section 698 of the Local Government Act, enacts as follows:
1. The owners of the property located at 308 Benson Street, legally described as Lot 11 and Lot 12, Block 21, Section 34, Township 23, Range 2, West of the 6th Meridian, Kootenay District, Plan 9504, are hereby ordered to alter by way of removal of the portion(s) of the fence structure on the property that do not conform to City of Revelstoke Zoning Bylaw No. 1264.
2. In the event the owner does not take the action specified in Section 1 of this Bylaw, the City by its own forces or those of a contractor engaged by the City may enter on the property described above and remove the portions of fence structure that do not conform as referred to in Section 1.
3. In the event that the City is required to take action under Section 2 of this Bylaw, the City may recover the expense from the owner, together with costs and interest at the rate prescribed in the same manner as Municipal taxes pursuant to Section 269 of the Local Government Act.
4. This Bylaw may be cited for all purposes as "City of Revelstoke Fence Structure Alteration Bylaw No. 1705".
5. This Bylaw shall come into full force and effect upon its' adoption.
