Being a Bylaw to Establish an Advisory Planning Commission.
____________________________________________________________________


WHEREAS Section 898 of the Local Government Act RSBC, 1996, c323 provides that Council establish an Advisory Planning Commission to advise Council on all matters respecting land use, community planning or proposed Bylaws and permits under the Community Planning Section of the Act;

AND WHEREAS COUNCIL deems it desirable that all previous Bylaws be repealed to improve clarity and identify a Terms of Reference for the Commission;

NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia, in open meeting assembled, enacts as follows:

1. An Advisory Planning Commission (hereinafter called the "Commission") of the City of Revelstoke is hereby established utilizing the following Terms of Reference, which are the general guidelines for items to be referred to the Commission for review:

Terms of Reference

(1) Provide advice or recommendations on any matters which Council may refer to it from time to time including, but not limited to the following:

(a) OCP Amendments and Rezoning Applications,

(b) Review of preliminary development plans,

(c) Proposed Bylaw or Policy amendments, and,

(d) Improvement to administrative procedures relating to the functioning of the Commission.


(2) That Council may refer additional matters which it deems appropriate to the Commission for further review and consideration.

2. The Commission is created to assist Council in an advisory capacity on such matters as identified in the Terms of Reference and, for that purpose the following procedures be adopted:

(a) Notice of all matters referred by Council or the Environmental, Planning and Land Development Committee shall be in writing.

(b) The Commission shall have power to regulate its own procedure providing that such rules and regulations do not contravene any City of Revelstoke Bylaws or the Local Government Act or any other Act.

(c) The Commission shall not have any authority whatsoever to commit funds, enter into contracts or approve rezoning applications, development permits or development variance permits.

(d) The City of Revelstoke shall provide a municipal employee to act as Secretary to the Commission. The Secretary shall attend all meetings of the Commission and keep minutes of the proceedings including decisions made by majority vote.

(e) Notice of the meeting date together with the agenda and related staff reports shall be made available to each member with a copy forwarded to the Director of Corporate Administration.

(f) A Council member, employee or officer of the local government, or an Approving Officer may attend a meeting of the Commission in a resource capacity.

(g) The City Planner shall attend meetings of the Commission in an advisory capacity.

3. The membership of the Commission shall consist of nine (9) members as follows:

(a) (1) Nine (9) citizens shall be appointed as voting members of the Commission by resolution of the Council of the City of Revelstoke. Five (5) appointments shall be for a one (1) year term, four (4) for a two (2) year term and thereafter all such appointments shall be for terms of two (2) years each or until a successor is appointed.

(2) The nine (9) citizens appointed as voting members by Council shall each be a resident of the City of Revelstoke.

(3) The Council shall, when appointing the nine (9) citizen members of the Commission, give consideration to persons with a variety of backgrounds and experience.

(b) All meetings of the Commission shall consist of a minimum of five (5) members to constitute a quorum.

(c) The Commission shall at its first meeting and thereafter at its first meeting in each calendar year, elect a Chairperson and a Vice Chairperson who shall act in the absence of the Chairperson. The Chairperson shall preside at all meetings.

(d) The Chairperson or Vice - Chairperson of the Commission shall be entitled to vote at any meeting of the Commission. Any member of the Commission then present who abstains from voting, shall be deemed to have voted in the affirmative; and on a tie vote, the question shall be defeated.

(e) A member who is absent from three (3) consecutive meetings of the Commission without leave of the Commission or without reason satisfactory to the Chairperson shall forthwith cease to be a member.

(f) The Council shall have the power, by affirmative vote of not less than two-thirds of all members thereof, to remove any member of the Commission from office at any time.

(g) Where any member of the Commission or his/her family, employer or business associates has any interest in any matter being considered by the Commission, that member shall absent himself/herself from all discussions.

(h) As a matter of procedure, all issues referred to the Commission for review shall be forwarded on to Council with a recommendation.

4. No member of the Commission shall receive any remuneration by reason for his/her being a member of the Commission.

5. Every effort shall be made to hold meetings of the Commission on a regular basis.

6. The following Bylaws are hereby repealed:

Advisory Planning Commission Establishment Bylaw No. 844
Advisory Planning Commission Establishment Bylaw Amendment No. 1260.

7. That this Bylaw may be cited for all purposes as "The City of Revelstoke Advisory Planning Commission Establishment Bylaw No. 1650, 2001."
