A Bylaw To Dispose Of A Certain Portion Of A Public Highway
In Exchange For Such Lands As Are Necessary For The Purpose
Of Relocating Access To The Road Commonly Known As Westside Road

WHEREAS under Section 535 of the Municipal Act, the Municipal Council may, by Bylaw, dispose of a portion of highway in exchange for land necessary for the purpose of improving, widening, straightening, relocating or diverting a highway;

AND WHEREAS it is deemed desirable to relocate access to the road commonly known as Westside Road;

NOW THEREFORE the Council of the City of Revelstoke, in open meeting assembled, enacts as follows:

1. Those parts of public highway comprising approximately 941 square meters from Mill Site 3, Plan DD14135 (P.I.D. 011-761- 920) except part in Plan R257, and approximately 226 square
meters from Mill Site 2, Plan DD14135 (P.I.D. 011-761-938)
except part in Plan R257, and approximately 182 square meters
from Mill Site No. 1 Plan DD14135 (P.I.D. 01l-761-954) except
part in Plan R257 all in Sections 32 and 33, Tp. 23, Rge. 2,
W.6.M., Kootenay District all of which are shown as closed road on the Reference Plan prepared by Russell N. Shortt, B.C.L.S. and completed by him on August 12, 1999, a copy of which is
attached hereto as Schedule "A", are hereby stopped up and
closed to all traffic and cease forever to be public highway.

2. The City of Revelstoke is hereby authorized to convey to
Philip Beattie and Hilyn Holdings Ltd. those parts of public
highways described as :

(a) approximately 941 square meters from Mill Site 3, Plan DD14135 (P.I.D. 011-761-920) except part in Plan R257, and

(b) approximately 226 square meters from Mill Site 2, Plan DD14135 (P.I.D. 011-761-938) except part in Plan R257, and

(c) approximately 182 square meters from Mill Site 1, Plan DD14135, P.I.D. (011-761-954) except part in Plan R257 all in Sections 32 and 33, Tp. 23 Rge. 2, W.6.M., Kootenay District,

all of which are shown as closed road on the Reference Plan prepared by Russell N. Shortt, B.C.L.S. and completed by him on August 12, 1999, a copy of which is attached hereto as Schedule "A".

3. In exchange for the parcels of land aforesaid, the City of
Revelstoke is hereby authorized to accept from Philip Beattie
and Hilyn Holdings Ltd. those parcels of land described as:

(a) 3358 square meters of Mill Site 1, Plan DD14135 (P.I.D.
011-761-954) except part in Plan R257.

(b) 361 square meters of Mill Site 2, Plan DD14135 (P.I.D.
011-761-938) except part in Plan R257.

(c) 1338 square meters of Mill Site 3, Plan DD14135 (P.I.D.
011-761-920) except part in Plan R257.

(d) 1592 square meters of Mill Site 4, Plan DD14135 (P.I.D.
011-761-881) all in Sections 32 and 33, Tp. 23, Rge. 2,
W.6.M., Kootenay District,

all of which are shown as open road on Schedule "A" attached hereto, which parcels of land shall be vested in the name of the Crown and are hereby set apart and established as a public highway.


4. The Mayor and Clerk of the City of Revelstoke are hereby
authorized to execute such conveyances, deeds, maps, plans,
receipts and documents on behalf of the City of Revelstoke
as may be necessary for the purposes aforesaid and to
affix the Corporate Seal of the City of Revelstoke thereto.

5. The Council shall, before adopting this Bylaw, cause public
notice of its intention to do so to be given by advertisement
once each work for two consecutive weeks in a newspaper
published or circulating in the City of Revelstoke.

6. This Bylaw may be cited for all purposes as the "City of
Revelstoke Westside Road Exchange and Dedication Bylaw #1618,
1999.

7. This Bylaw shall take effect upon the date of its' adoption by
City Council.

1st DAY OF SEPTEMBER , 1999.


RECONSIDERED AND FINALLY ADOPTED THIS 13th DAY OF SEPTEMBER , 1999.
