CITY OF REVELSTOKE
BYLAW #1590, 1998

Being a Bylaw to authorize the demolition and removal of a carport/storage structure which was constructed without a permit and does not conform with the British Columbia Building Code 1992

WHEREAS the Council of the City of Revelstoke, Province of British Columbia deem it necessary to order, by Bylaw, the demolition and removal of an unpermitted structure.
NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia, in open meeting assembled, pursuant to Section 698 of the Municipal Act, enacts as follows:
1. The owner of the property located at 1004 Victoria Road, legally described as Lot 6 and Lot 7, Block 66, Section 27, Township 23, Range 2, West of the 6th Meridian, Kootenay Land District, Plan 925, is hereby ordered to demolish and remove the above noted carport/storage structure which was constructed without a permit and does not conform to the British Columbia Building Code and is located within the required frontyard setback of 19.7'.
2. In the event the owner does not take the action specified in Section 1 of this Bylaw, the City by its own forces or those of a contractor engaged by the City may enter on the property described above and remove the unpermitted structure referred to in Section 1.
3. In the event that the City is required to take action under Section 2 of this Bylaw, the City may recover the expense from the owner, together with costs and interest at the rate prescribed in the same manner as Municipal taxes pursuant to Section 269 of the Municipal Act.
4. This Bylaw may be cited for all purposes as "City of Revelstoke Structure Demolition and Removal Bylaw No.1590, 1998".
5. This Bylaw shall come into full force and effect upon its' adoption.
