A Bylaw To Authorize The Granting Of A Lease Of Real Property
___________________________________________________________________
WHEREAS pursuant to Section 316 of the Municipal Act, Council may lease property that is owned or held by the Municipality.
NOW THEREFORE the Council of the City of Revelstoke, in open meeting assembled, enacts as follows:
1. The City of Revelstoke is hereby authorized and empowered to enter into a lease with Downie Timber Ltd. for that parcel of land legally described as follows:
That part of Block D (See 154488I)
Section 27, Township 23, Range 2, West of the Sixth
Meridian, Kootenay District, Plan 636M, shown outlined
in red on the attached plan.
2. Downie Timber Ltd. shall pay to the City of Revelstoke the sum of $5,499.96 plus GST, per annum commencing March 1, 1998.
3. The lease shall be for a period of one (1) year and will automatically renew itself from year to year on the same terms and conditions including the provision for automatic renewal unless written notice of termination or notice of interest to vary the amount of rent is given by either party to the other at least ninety (90) days before the lease, or any renewal thereof, expires.
4. The Mayor and Clerk are hereby authorized to sign and seal any and all instruments respecting said lands and the leasing thereof.
5. This Bylaw shall come into force and effect upon the date of its adoption.
6. This Bylaw may be cited for all purposes as the "City of Revelstoke and Downie Timber Ltd. Land Lease Bylaw #1580, 1998".
