Being a Bylaw to authorize the alteration of a prohibited overheight fence
______________________________________________________________________________
WHEREAS the Council of the City of Revelstoke deem it necessary to order, by Bylaw, the alteration of a prohibited overheight fence
NOW THEREFORE the Council of the City of Revelstoke, in open meeting assembled, pursuant to Section 698 of the Municipal Act, enacts as follows:
1. The owner of a fence located at 301 Eighth Street East, on property legally described as Lot 1 and Parcel A (see 177926I) of Lot 2, Block 62, Section 27, Township 23, Range 2, West of the 6th Meridian, Kootenay Land District, Plan 636I, is hereby ordered to alter the fence from the current height to a maximum of 1.1 metres (to conform to Section 5.14 of City of Revelstoke's Zoning Bylaw #1264) from the front of the existing residence to the front property line adjacent to property at 309 Eighth Street East, legally described as The Southeast 1/2 of Lot 2 and Lot 3, Block 62, Section 27, Township 23, Range 2, West of the 6th Meridian, Kootenay District, Plan 636I.
2. In the event the owner does not take the action specified in Section 1 of this Bylaw, the City by its own forces or those of a contractor engaged by the City may enter on the property described above and alter that portion of the fence referred to in Section 1.
3. In the event that the City is required to take action under Section 2 of this Bylaw, the City may recover the expense from the owner, together with costs and interest at the rate prescribed in the same manner as Municipal taxes pursuant to Section 269 of the Municipal Act.
4. This Bylaw may be cited for all purposes as "City of Revelstoke Structure Alteration Bylaw No. 1570, 1997".
5. This Bylaw shall come into full force and effect upon its' adoption.
