CONSOLIDATED FOR CONVENIENCE

All persons making use of this consolidated version of City of Revelstoke Ticket Information Utilization Bylaw No. 1780 are advised that it has no legislative sanction; that the amendments have been embodied for convenience of reference only and that the original bylaw must be consulted for all purposes of interpreting and applying the law.

Sub sections of the original bylaw and/or amendments which have been repealed have not been included in this consolidation.

Being a Bylaw to Repeal Bylaws Number 1475 and 1239 which established respectively the number of persons appointed to the Revelstoke Heritage Advisory Committee and the establishment of the Heritage Advisory Committee in and for the City of Revelstoke and to establish a new Community Heritage Commission

WHEREAS, the Council of the City of Revelstoke deem it prudent to establish a new Community Heritage Commission.

NOW THEREFORE the Council of the City of Revelstoke, Province of British Columbia, in open meeting assembled, enacts as follows:

TITLE

1. THAT this Bylaw may be cited for all purposes as the "City of Revelstoke Heritage Advisory Commission Establishment Bylaw #1565, 1997".

ESTABLISHMENT

2. THAT this commission be known as the "Revelstoke Community Heritage Commission" (hereinafter referred to as "the Commission") is hereby established pursuant to Part 30 of the Municipal Act, R.S. Chapter 290.

MEMBERSHIP

3. (a)
*Amended Bylaw No. 1887 THAT the members of the commission shall be a maximum of 12 in number and shall be appointed at any regular meeting of Council; 50% of appointed members of the commission shall constitute a quorum.

(b) THAT members of the commission are appointed by a majority vote of City Council at any time during the calendar year.

(c) THAT members of the commission shall be appointed for a three year term which may be extended by a council resolution for a further three year term.

OPEN MEETINGS

4. THAT meetings of the commission are open to the public except for those meeting or portions of meetings where matters of property or finances are considered.

PROCEDURES

5. (a) THAT the commission shall be presided over by a Chair selected from the commission who shall be elected annually by a majority of the members of the commission in attendance.

(b) THAT in the absence of the Chair the commission shall be presided over by a Vice-Chair selected from the commission who shall be elected annually by a majority of the members of the commission in attendance. (c) THAT a member of City Council will be a representative to the commission, and will be a non-voting member.

(d) THAT a staff liaison will be appointed to the commission and will be a non-voting member.

(e) THAT meetings of the commission will be at the call of the Chair who will ensure that at least 24 hours notice is given of each meeting provided that such notice may be waived by a majority vote of the commission.

(f) THAT the Chair shall maintain a civil atmosphere at all meetings and decide any points of order which may arise.

(g) THAT all questions requiring a decision before any meeting of the commission shall be decided by a majority of the members present and the Chair shall have a deciding vote in the event of a tie vote.

(h) THAT the Chair will ensure that minutes of all meetings and proceedings be recorded and stored and after their adoption by the commission, sign and provide the original copy to the City Clerk.

(i) THAT save with respect to matters expressly dealt with or provided for in this Bylaw, the rules governing proceedings of the commission shall be those governing proceedings of the City Council under the Procedural Bylaw of Council, insofar as the rules may be applicable.

(j) THAT the commission will report to City Council by providing a copy of its' minutes to the appropriate Committee of City Council which indicates any required actions or requests. Also, the commission will provide copies of any reports, correspondence, or other materials which have been prepared as a result of the commission's activities.

TERMS OF REFERENCE

6. The commission's responsibility is to broadly advise City Council on those matters relating to the built form, cultural, and natural heritage of the community; included in this matter is making recommendations respecting designation of heritage structures and lands and the demolition, preservation, alteration or renovation of these. Such activities would be limited to the following:

(a) To respond to referrals made to the commission by City Council; where possible, the response to be provided along with any relevant recommendation to the next general meeting of City Council.

(b) To establish a community heritage register listing real property that is considered to have heritage value or character and includes the reasons for inclusion in the register. This could include reasons of history, architecture or design, historical events, natural features, events or persons and grouping of structures, amongst others.

(c) To prepare guidelines for the renovation of existing structures and lands, and for the construction of new structures and landscaping which may vary in an area by area basis within the City.

(d) To investigate the creation of a foundation or similar institution which could accept funds which could be distributed as "seed money" as an incentive for those desiring to restore or rehabilitate certain types of structures and report back to City Council.

(e) To review City Bylaws or other regulations which may be acting as a hinderance to building restoration or rehabilitation.

(f) To examine the idea of tax exemption or reduction to act as an incentive for building restoration or rehabilitation and report back to City Council.

(g) To prepare a self guided, walking tour of heritage sites and areas of the City.

(h) To foster an awareness of the importance of heritage places from an economic, social, environmental and aesthetic points of view.

(i) To provide on a frequent basis, recognition by awards given to different categories of heritage improvements which have taken place in a certain time period, such as, best complete residential renovation, best residential detail, best commercial renovation amongst others.

(j) To evaluate the need to establish one, or more heritage conservation areas where a collection of certain values or features collectively affect the heritage of the community.

(k) To develop concepts for having heritage created today that can be left as a legacy of our times for those who come after.

7. THAT the City of Revelstoke Heritage Advisory Committee Establishment Bylaw #1239, 1982, and the City of Revelstoke Heritage Advisory Committee Establishment Amendment Bylaw #1475, 1993, are hereby repealed in their entirety.

8. THIS Bylaw shall take effect upon the date of it's adoption by City Council.
