CITY OF REVELSTOKE
BYLAW NO. 1499, 1995
A Bylaw to Control the Use of Firearms Within the Boundaries Of The City of Revelstoke
The Council of the City of Revelstoke, in open meeting assembled, enacts as follows:
1. DEFINITIONS:
"FIREARM": Any barrelled weapon from which any shot, bullet or other projectile can be discharged and that is capable of causing serious bodily injury or death to a person and includes any frame or receiver of such a barrelled weapon and anything that can be adapted for use as a firearm.
The following weapons shall be deemed not to be firearms:
a) An antique firearm unless:
(i) it would be a restricted weapon; (ii) the person in possession thereof intends to discharge it.
b) Any device designed and intended by the person in possession thereof for use exclusively for:
(i) signalling, notifying of distress or firing stud cartridge, explosive-driven rivets or similar industrial ammunition; or (ii) firing blank cartridges.
c) Any shooting device designed and intended by the person in possessin thereof for use exclusively for:
(i) slaughtering of domestic animals; (ii) tranquilizing animals; or (iii) discharging projectiles with lines attached thereto; and
d) Any other barrelled weapon where it is proved that the weapon is not designed or adapted to discharge a shot, bullet or other missile at a muzzle velocity exceeding 152.4 m/sec or discharge a shot, bullet or other missile that is designed or adapted to attain a velocity exceeding 152.4 m/sec.
2. PROHIBITION:
Except as expressly provided in this Bylaw, no person shall discharge a firearm within the boundaries of the City of Revelstoke.
3. PERMIT HOLDERS:
Section 2 of this Bylaw does not apply to persons authorized to discharge a firearm pursuant to a regulation or permit issued under the Firearm Act, R.S.B.C. 1979, c. 134.

4. INDOOR SHOOTING RANGE:
Section 2 of this Bylaw does not apply to persons holding a permit issued under the Firearm Act to establish and maintain an indoor shooting range and to discharge a firearm in the indoor shooting range.
5. OUTDOOR SHOOTING RANGE:
(a) Section 2 of this Bylaw does not apply to a persons discharging firearms within a lawfully established outdoor shooting range in a zone in which such a use is permitted by the City of Revelstoke Zoning Bylaw, if the person holds a valid permit issued by the owner or operator of the shooting range, is authorized by owner or operator and the shooting range has been certified pursuant to Section 5(e) of this Bylaw.
(b) The exemption provided by Section 5(a) applies only between the hours of 10:00 a.m. and 8:00 p.m. Monday to Friday; 10:00 a.m. and 6:00 p.m. Saturday; and 12:00 noon and 4:00 p.m. Sunday.
(c) Despite Section 5(b), the hours on Sunday on which the discharging of firearms in an outdoor shooting range is not prohibited shall be 10:00 a.m. to 6:00 p.m. on the following Sundays in any calendar year:
i) Father's Day; ii) the last weekend in September; and iii) up to seven other Sundays that are specified in writing to the City by the gun club operating the outdoor shooting range by March 31, in that calendar year.
(d) The exemption provided by Section 5(a) of this Bylaw does not apply on any four days of which the registered owner of Lot 1, Plan 17018, Section 24, Township 23, Range 2, Meridian 6, Kootenay Land District shall advise the Administrator of the City in writing on or before March 31 in any calendar year; but none of those four days may be days referred to in Section 5(c).
(e) For the purposes of Section 5(a) of this Bylaw, a member of the Revelstoke Detachment of the Royal Canadian Mounted Police shall certify in writing, that an outdoor shooting range of which the member is not a regular user, is being operated in accordance with safe firearms practice, and such certification shall be provided to the Administrator of the City on or before June 30, 1995 and on that date every five (5) years thereafter.
6. SEVERABILITY:
Section 5(c), (d) and (e) of this Bylaw are enacted on the basis that, should any of them at any time be held by a Court to be invalid, they are severable from the Bylaw.
7. PENALTY:
A person who violates a provision of this Bylaw commits an offence and is liable upon conviction to the penalties provided in the Offence Act.
8. REPEAL:
City of Revelstoke Firearms Bylaw #1393, 1990 is repealed.

9. CITATION:
This Bylaw may be cited for all purposes as the "City of Revelstoke Firearms Bylaw No. 1499, 1995".
