A Bylaw to dispose of a certain portion of a public highway in exchange for such lands as are necessary for the purpose of improving and straightening a portion of Fir Street

WHEREAS under Section 574 of the Municipal Act, R.S.B.C. l979, Chapter 290, the Municipal Council may, by Bylaw, dispose of a portion of highway in exchange for land necessary for the purpose of improving, widening, straightening, relocating or diverting a highway;


AND WHEREAS it is deemed desirable to improve and straighten a portion of Fir Street;


NOW THEREFORE the Council of the City of Revelstoke, in open meeting assembled, enacts as follows:


l. Those parts of public highway comprising approximately
42.3 sq.m. shown as "Closed Road" on the Reference Plan
prepared by Russell N. Shortt, B.C.L.S., and completed by
him on October l, l993, a copy of which is attached hereto
as Schedule "A", are hereby stopped up and closed to all
traffic and cease forever to be public highway.

2. The City of Revelstoke is hereby authorized to convey to
David J. Kruger and Marsha N. Kruger of the City of
Revelstoke, those parts of public highway comprising
approximately 42.3 sq.m. shown as "Closed Road" on the
Reference Plan prepared by Russell N. Shortt, B.C.L.S.,
and completed by him on October l, l993, a copy of which
is attached hereto as Schedule "A".

3. In exchange for the parcel of land aforesaid, the City of
Revelstoke is hereby authorized to accept from David J.
Kruger and Marsha N. Kruger that parcel of land described
as part of Lot l, Block 64, Plan 925, Sec. 27,
TP. 23, Rge. 2, West of the 6th Meridian, Kootenay
District comprising approximately l9.9 sq.m. shown as
"Open Road" on Schedule "A" attached hereto, which parcel
of land shall be vested in the name of the Crown and is
hereby set apart and established as a public highway.

4. The Mayor and Clerk of the City of Revelstoke are hereby
authorized to execute such conveyances, deeds, maps, plans, receipts and documents on behalf of the City of
Revelstoke as may be necessary for the purposes aforesaid
and to affix the Corporate Seal of the City of Revelstoke
thereto.

5. The Council shall, before adopting this Bylaw, cause public notice of its intention to do so to be given by
advertisement once each week for two consecutive weeks
in a newspaper published or circulating in the City of
Revelstoke.

6. This Bylaw may be cited for all purposes as the City of
Revelstoke Fir Street Exchange and Dedication Bylaw #l486,
l994.

7. This Bylaw shall take effect upon the date of its adoption by City Council.

PUBLIC NOTICE OF INTENTION TO PROCEED ADVERTISED IN THE REVELSTOKE TIMES/REVIEW ON THE 17th DAY OF JUNE , 1994, AND ON THE 21st DAY OF JUNE , 1994.

RECONSIDERED AND FINALLY ADOPTED THIS 27th DAY OF JUNE , 1994.
