A By-Law To Provide For The Determination Of Various Procedures For The Conduct Of Local Government Elections And Other Voting
_________________________________________________________________

Under the Municipal Act, the Council may, by bylaw, determine various procedures and requirements to be applied in the conduct of local government elections and other voting

Council wishes to establish various procedures and requirements under that authority.

The Council of the City of Revelstoke, in open meeting assembled, enacts as follows:

l. Definitions

In this By-law:

"Elector" means a resident elector or property elector of the jurisdiction as defined under the Municipal Act;

"Election" means an election for the number of persons required to fill a local government office;

"General local election" means the elections held for the mayor and all councillors of the municipality which must be held in the year 1993 and every 3rd year after that;

"General Voting Day" means,

(a) for a general local election, the 3rd Saturday of
November in the year of the election,

(b) for other elections, the date set under sections 38(5),
39(l) or (3) or l42(5) of the Municipal Act, and

(c) for other voting, the date set under section l62 of the
Municipal Act;

"Jurisdiction" means, in relation to an election, the municipality for which it is held;

"Local Government" means,

(a) in relation to a municipality, the council.

(b) in relation to a regional district, the board;

"Other Voting" means voting on a matter referred to in Section l58 of the Municipal Act and includes voting on a referendum under section 283 (s 790.l) of that Act.

1. Required Advance Voting Opportunities

(a) As authorized under Section 97 (2) (a) and (b), at
least 2 advance voting opportunities must be held for
an election by voting.

(i) one on the l0th day before general voting day, and

(ii) the other on the 8th day before general voting day
except when the 8th day before the general voting
day falls on a statutory holiday, in which case the
other required advance voting opportunity will be
held in the 9th day before general voting day.

2. Additional Advance Voting Opportunities

(a) As authorized under Section 98 of the Municipal Act, the
Council authorizes the Chief Election Officer to establish
additional advance voting opportunities for each election,
or specified election, or other voting, to be held in
advance of General Voting Day and to designate the
voting places, establish the date and the voting hours
for these voting opportunities.

3. Special Voting Opportunities

(a) As authorized under Section 99 of the Municipal Act, the
Council authorizes the Chief Election Officer to establish
a Special Voting Opportunity for each election, or a
specified election, or other voting, and to designate the
locations, the date and the voting hours within the limits
set out in Section 96(2) of the Municipal Act, for the
Special Voting Opportunity.

4. Resolution of Tie Votes After Judicial Recount

(a) In the event of a tie vote after a judicial recount, the
tie vote will be resolved by conducting a lot in
accordance with Section l4l of the Municipal Act.

5. Conduct of Elections on behalf of the Columbia-Shuswap Regional
District and School District #l9.

The City may by agreement, and if requested, conduct elections
on behalf of School District #l9 and the Columbia-Shuswap
Regional District.

6. Citation

This By-law may be cited for all purposes as the "City of
Revelstoke Local Government Elections and other Voting
Procedures By-law #l470, l993."

7. Repeal of By-law.

That the City of Revelstoke Advance Poll and Mobile Poll
By-law #l32l, l987 be repealed in its' entirely.

8. That this By-law shall come into full force and effect upon
its' adoption thereof.
