MINUTES OF THE REGULAR COUNCIL MEETING HELD IN COUNCIL CHAMBERS MONDAY, JUNE 12, 2006,

CALL TO ORDER:

Mayor McKee called the meeting to order at 3:30 p.m. and welcomed everyone in attendance.


ADOPTION OF THE AGENDA:

Mayor McKee advised that Item No. 10.g) Woolsey Creek Café’s Application for Entertainment Endorsement will be brought forward to follow after the Delegations and Business Arising from the Minutes due to the public’s attendance for this issue.

Moved by Councillor Richardson, seconded by Councillor Gibbs that the Agenda be adopted as presented with the Application for Entertainment Endorsement item moving forward.

ADOPTION OF THE MINUTES:

1. Regular Council Meeting – May 23, 2006

Moved by Councillor Gibbs, seconded by Councillor Frew that the Minutes of the Regular Council Meeting held May 23, 2006 be approved as presented.

2. Receive Public Hearing Minutes – May 8, 2006

Moved by Councillor Richardson, seconded by Councillor Gibbs that City Council receive the Minutes of the Public Hearing held May 8, 2006.
CARRIED


DELEGATIONS:

1. Dennis Berarducci Re: Arena Seating

Dennis Berarducci reported that $12,000 was raised to purchase seats for installation in the Arena. There were 252 seats mounted and 150 more were ordered. Mr. Berarducci praised the Director of Parks and Recreation, Alan Chell, for his hard work and dedication to sports in the City of Revelstoke. The seats that were installed from the Roxy Theatre will be cleaned and scotch guarded. Mr. Berarducci requested $2,000 from City Council to purchase name plates to be installed in the front of the fold up seats. Councillor Singh extended appreciation to Mr. Beraducci for his work at the Arena on behalf of the City of Revelstoke.

Moved by Councillor Singh, seconded by Councillor Richardson that the $2,000 funding request from Dennis Berarducci, to purchase name plates for seating in the Arena, be referred to the Parks and Recreation Committee and the Finance Committee for report back to Council.
CARRIED

Mayor McKee thanked Mr. Berarducci for his presentation and his work over the years to improve conditions in the Arena including his Hockey History Project. Mr. Berarducci then retired from Council Chambers.

2. Mengia Nicholson Re: World Elder Abuse Awareness

Mengia Nicholson advised that she is the Coordinator for the Revelstoke Community Response Network (RCRN) and was presenting information on World Elder Abuse. The first annual World Elder Abuse Awareness Day is on June 15, 2006. The Revelstoke CRN is raising awareness and working with agencies to address abuse and neglect to seniors. There are approximately 590 citizens over the age of 65 in Revelstoke and one-third are members of the Seniors Association. Communities need to keep its senior residents safe. Mrs. Nicholson provided additional information for the public and a resource package for City Council.

Mayor McKee thanked Mrs. Nicholson for her presentation and advised that the City will support this cause by having the pamphlets available for the public to pick up.

3. Norm Macdonald, MLA, Columbia River-Revelstoke

Norm Macdonald advised that Mengia Nicholson is the Constituent Assistant along with Angela Howe and that he was present today with Mr. McEachern from Australia. He congratulated the City and the community on the success of the Okanagan Mainline Municipal Association Convention and that Council made the delegates and Provincial Representatives feel welcome. The Province of British Columbia is bringing the Trans Canada Highway improvements and dam taxation forward along with a number of issues such as health, forestry, education, income assistance, affordable housing, and the Mount Mackenzie Project. Mr. Macdonald was interested in receiving additional information on what the City of Revelstoke is looking at on Affordable Housing. Further, the Province needs to be mindful of local decision making on land use, there are limitations on property taxation which the Union of BC Municipalities is involved and the removal of local governments from zoning of power projects. Should the community have additional issues to be addressed, it may be dealt with through resolutions to OMMA and UBCM.

Mayor McKee extended appreciation on behalf of the City Council for Norm Macdonald’s accessibility and taking the City’s concerns forward.

COMMITTEE REPORT – COUNCILLOR MACFARLANE, Chair Planning and Land Development

1. Woolsey Creek Café – Application for Entertainment Endorsement

It was reported that four additional letters were received during the Council Meeting.

Moved by Councillor MacFarlane, seconded by Councillor Johnston that

1. Council recommends the approval of a Food Primary Entertainment Endorsement to the Liquor License granted to the Woolsey Creek Café under the provisions of the Liquor Control Licensing Act.

2. Council’s comments are as follows:

a. that, in order to mitigate noise, event activities are confined within the premises of the Woolsey Creek Café and that the outdoor patio is closed during event activities;
b. on balance, the impact on the community will be favourable; and
c. the Entertainment Endorsement will support patron participation entertainment in a more controlled manner and mitigate collateral activities that have taken place in the past when entertainment functions were held without the benefit of an Entertainment Endorsement.

3. That Council has solicited the views of residents through comments received at a Public Information Meeting held on June 1, 2006, through letters received as a result of public advertisements, and other informal methods of expression. A copy of these various public remarks are attached for review by the Ministry of Public Safety and Solicitor General.

1. Vintage Car Club of Canada Re: Request to Close a Portion of Mackenzie Avenue and First Street – August 19, 2006

Moved by Councillor Frew, seconded by Councillor MacFarlane that Council approve the temporary Street Closure of Mackenzie Avenue between Victoria Road and Third Street and First Street from Orton Avenue to Connaught Avenue on Saturday, August 19, 2006 from 4:00 p.m. to 10:00 p.m. to hold a car show in conjunction with Railway Days.

2. City of Port Alberni Re: Kraft Hockeyville

Moved by Councillor MacFarlane, seconded by Councillor Frew that a letter be written to MLA Norm Macdonald, Columbia River – Revelstoke, to encourage an initiative to help all communities to maintain quality recreational facilities and that information on the Port Alberni initiative be referred to the Parks and Recreation Committee of Council for review.

3. City of Fernie Re: Resort Community Collaborative

Moved by Councillor MacFarlane, seconded by Councillor Frew that the City of Revelstoke become a member municipality in the Resort Community Collaborative.

4. Minister Rick Thorpe Re: Property Tax Deferment Program

Moved by Councillor MacFarlane, seconded by Councillor Richardson that Provincial Property Tax Deferment Program information be sent to the Seniors Association and that this be reported out to the public in the next Mayor’s Report.
CARRIED

5. Marina and Frank Huyler and Eve Fisher Re: Painted Turtles

Moved by Councillor Frew, seconded by Councillor Singh that the correspondence on the Painted Turtles be referred to the Public Works Committee of Council for review and report back to City Council.

6. Senator Mac Harb Re: Support for Making Canada Smoke-free in all Workplaces and Public Spaces under Federal Jurisdiction

Moved by Councillor MacFarlane, seconded by Councillor Richardson that the correspondence on Smoke-Free in all Workplaces and public spaces be referred to the Social Committee of Council and the Revelstoke Air Quality Committee for consideration.
CARRIED

Councillor Frew noted that the community may also report to Senator Harb and that it should be addressed to the public through the Mayor’s Report.

7. Union of BC Municipalities Re: 2006 Resolutions Deadline

Moved by Councillor MacFarlane, seconded by Councillor Frew that the City provide a letter of support for Province-wide legislation to ensure that fuel sales are paid before it is pumped.

10. Revelstoke Hospital Auxiliary Re: Renew Crew

Moved by Councillor Richardson, seconded by Councillor Gibbs that a letter be sent to the Big Brothers and Sisters advising that the City of Revelstoke does not support the Renew Crew as displayed in the flyers that were distributed by mail and that the City advertise that it is not associated to the Big Brothers and Sisters.

1. Statement of Financial Information

Moved by Councillor Frew, seconded by Councillor Gibbs that the 2005 Statement of Financial Information be approved by Council and be sent to the Ministry of Community Services as per Section 2 of the Financial Information Act.

Moved by Councillor MacFarlane, seconded by Councillor Johnston that Council gives First and Second Readings to City of Revelstoke Zoning Amendment Bylaw No. 1831, that a Public Hearing be waived pursuant to Section 890 of the Local Government Act, and that notice of the Public Hearing being waived is given pursuant to Section 893 of the Local Government Act.

4. Resolution to Abandon City of Revelstoke Official Community Plan Amendment Bylaw No. 1773 (Mount Mackenzie Resort)

Moved by Councillor MacFarlane, seconded by Councillor Johnston that City of Revelstoke Official Community Plan Amendment Bylaw No. 1773 for the Mount Mackenzie Resort be abandoned.

5. City of Revelstoke Official Community Plan Amendment Bylaw No. 1832 (Mt. Mackenzie Resort Area) and Schedule a Public Hearing

Moved by Councillor MacFarlane, seconded by Councillor Frew that City of Revelstoke Official Community Plan Amendment Bylaw No. 1832 receive First and Second Readings by City Council and that a Public Hearing be scheduled for 3:00 p.m. on Monday, July 10, 2006 at the Fire Hall.

6. Application for a Structural Change: Regent Inn Liquor Primary – 112 First St. E.

Moved by Councillor MacFarlane, seconded by Councillor Gibbs that

1. Council supports the application for a Structural Change for the Regent Inn as applied for:

Patio 1 – Outdoor Patio fronting 112 First Street West; and
Patio 2 – Outdoor Patio located at the back of 112 First Street West

2. Council’s comments on the prescribed considerations are as follows:

a. The potential for noise and vandalism if the application is approved: Patio 1 has been in operations for one year, Patio 2 has been in operation since 1999 and to date, no noise complaints or reports of vandalism have been received.
b. The impact on the community if the application is approved: The impact of the community has not changed since the patios have been in operation.

3. Council’s comments on the views of residents are as follows:

The views of residents were not gathered in this case given that Patio 1 operated last year without any complaints from neighbouring residents and that Patio 2 has been in operation since 1999, and to date, no complaints have been received.

2. Snowmobile Revelstoke Society

Moved by Councillor Frew, seconded by Councillor Johnston that Councillor Gibbs be appointed as a Council representative to the Snowmobile Revelstoke Society.

RESOLVE INTO IN CAMERA:

BUSINESS ITEMS TO REPORT:

1. Lease Agreement - Directional Signage Space on Victoria Road

Council approved the Lease of directional signage space on Victoria Road with Revelstoke Nickleodeon Corporation and authorized the Mayor and Chief Administrative Officer to sign.


ADOPTION OF RESOLUTION(S):

Moved by Councillor Frew, seconded by Councillor Richardson that the resolution(s) as approved by Council In Camera, be adopted.
