MINUTES OF THE REGULAR COUNCIL MEETING HELD IN COUNCIL CHAMBERS MONDAY, AUGUST 22, 2005,
COMMENCING AT 3:30 P.M.

CALL TO ORDER:

Mayor McKee called the meeting to order at 3:29 p.m. and welcomed everyone in attendance.


ADOPTION OF THE AGENDA:

Moved by Councillor O’Hagan, seconded by Councillor Frew that the Agenda be adopted with the following addition to item 7c) Memo from Councillor Singh – DCC Bylaw.

ADOPTION OF THE MINUTES:

1. Regular Council Meeting – August 8, 2005

Moved by Councillor Richardson, seconded by Councillor Frew that the Minutes of the Regular Council Meeting held August 8, 2005 be approved as presented.
CARRIED

2. Public Hearing – August 8, 2005

Moved by Councillor Frew, seconded by Councillor Johnston that the Minutes of the Public Hearing held August 8, 2005 be received by Council.
CARRIED


BUSINESS ARISING FROM THE MINUTES:

Moved by Councillor Singh, seconded by Councillor Richardson that the request from Richard Eby to close Grizzly Plaza Sept 10, 2005 be granted.

3. Margaret Pacaud Re: Request for Mountain Arts Festival in Grizzly Plaza – September 16-18, 2005

Moved by Councillor Johnston, seconded by Councillor Richardson that the request from Margaret Pacaud to close Grizzly Plaza for the Mountain Arts Festival September 16-18, 2005 be approved.

COMMITTEE REPORTS:


COUNCILLOR FREW, Chair Public Works and Protection

1. Monthly Animal Control Report – July 18-31, 2005

2. Monthly Revelstoke Fire Department Report – July 2005

3. City of Revelstoke Development Cost Charge Bylaw No. 1781 – Third Reading

Moved by Councillor Frew, seconded by Councillor Johnston that City of Revelstoke Development Cost Charge Bylaw No. 1781 receive Third Reading and proceed with the approval process.

Moved by Councillor Singh, seconded by Councillor Richardson that staff be instructed to investigate and report back on the implications of a future amendment to Bylaw No. 1781 to provide that Council may waive the DCC for developers of low-income housing, where the developers will subscribe to rate controls for rent and standards of maintenance. Also that it be referred to the Housing Committee and appropriate agencies.

COUNCILLOR JOHNSTON, Chair Planning and Land Development

1. Minutes of a Planning Committee Meeting – August 10, 2005

i. Delegation - Bill Lahowy – 404 Charles

Moved by Councillor Johnston, seconded by Councillor Frew that the Planning Department be authorized to prepare the Zoning Amendment Bylaw.
CARRIED

ii. City of Revelstoke / Airport Way

Moved by Councillor Johnston, seconded by Councillor Singh that the Planning Department prepare the Zoning Amendment Bylaw and that the Planning Department be authorized to notify the applicants that a Public Notification sign will be required.
CARRIED

iii. Provincial Rental Housing Corp. / 708,712,716,& 720 Second Street West

Moved by Councillor Johnston, seconded by Councillor Richardson that the Planning Department be authorized to draft Development Permit No. 2005-39; and

That the applicant be required to provide the following information:

a) Submission of a landscaping plan, fee estimate and letter of credit to cover landscaping works,
b) Submission of a revised site plan to identify lot dimensions and screened refuse container,
c) Consideration of the concerns expressed by the Mayor’s Advisory Committee on Health Care, and
d) Reconsideration of the architectural components to enhance the heritage characteristics of the building.

iv) Mihaly Vegh / 201 First Street East

Moved by Councillor Johnston, seconded by Councillor Frew, that the Planning Department be authorized to draft Development Variance Permit No. 2005-42; and that the owner be required to register a Restrictive Covenant to ensure that the area under the covered patio will not be used for storage.

v) Amendment to Secondary Suite Regulations

Moved by Councillor Johnston, seconded by Councillor Singh, that the Planning Department be authorized to prepare the Zoning Amendment Bylaw.
CARRIED

vi) Parks Master Plan Review

Moved by Councillor Johnston, seconded by Councillor Singh that the Planning Department be authorized to prepare the Official Community Plan Amendment to amend Section 14 ‘Parks and Trails’

vii) Urban / Wildland Interface Fire Protection Policy

Moved by Councillor Johnson, seconded by Councillor O’Hagan that the Planning Department be authorized to pursue funding to complete a Fire Hazard Map.
CARRIED

Councillor Frew requested that perhaps the City should review the plan from the City of Kamloops’ and do some research and it may be possible to do the project in house. Once the research is complete it will be easier to determine who will be better suited to do the project.

2. City of Revelstoke Official Community Plan Amendment Bylaw 1796 - 708, 712, 716 & 720 Second Street West

Moved by Councillor Johnston, seconded by Councillor O’Hagan that City of Revelstoke Official Community Plan Amendment Bylaw 1796 be given Third Reading and Final Adoption.

3. City of Revelstoke Zoning Amendment Bylaw No. 1797 - 708, 712, 716, & 720 Second Street West

Moved by Councillor Johnston, seconded by Councillor O’Hagan that Section 1 be amended (from Institutional (P3) to Parks and Public Use District (P1); and that City of Revelstoke Zoning Amendment Bylaw 1797 be given Third Reading and Final Adoption.

4. City of Revelstoke Official Community Plan Amendment Bylaw No. 1798/ Development Permit Area F

Moved by Councillor Johnston, seconded by Councillor Richardson that City of Revelstoke Official Community Plan Amendment Bylaw No. 1798 be given Third Reading and Final Adoption.
CARRIED

5. Development Variance Permit No. 2005-38 (1000 2nd St W.) Mike & Stacey Brunetti

Moved by Councillor Johnston, seconded by Councillor Singh that Development Variance Permit No. 2005-38 be issued.
CARRIED

6. City of Revelstoke Zoning Amendment Bylaw No. 1800

Moved by Councillor Johnston, seconded by Councillor O’Hagan that City of Revelstoke Zoning Amendment Bylaw No. 1800 receive First and Second readings and that a Public Hearing be scheduled for 3:00pm Monday September 19, 2005.

8. City of Revelstoke Official Community Plan Amendment Bylaw No. 1801 – Parks Master Plan

Moved by Councillor Johnston, seconded by Councillor O’Hagan that the City of Revelstoke Official Community Plan Amendment Bylaw No. 1801 receive First Reading.

1. Planning Grant Submission by Community Energy Association

Moved by Councillor Frew, seconded by Councillor Richardson that Council support the Planning Grant submission by the CEA as presented subject to the Ministry being made aware that the existing City applications for Arrow Heights Sewerage Planning Study and Water Model Calibration are priorities.

2. City of Revelstoke Laneway Closure Bylaw No. 1791

Moved by Councillor Johnston, seconded by Councillor Richardson that the City of Revelstoke Laneway Closure Bylaw No. 1791 be given final consideration and adoption.
CARRIED

3. Employment Services – Support Letter

Moved by Councillor Frew, seconded by Councillor Singh that Council send a letter of support that these services continue to operate locally providing assistance to the residents of Revelstoke.

RESOLVE INTO IN CAMERA:

Moved by Councillor Richardson, seconded by Councillor O’Hagan, that Council reconvene into In Camera at 4:19 p.m. to consider items of business pursuant to Section 90.(1) (c) & (e) of the Community Charter.

BUSINESS ITEMS TO REPORT:

1. Reschedule September 26, 2005 Regular Council Meeting

It was agreed that the September 26, 2005 Regular Council Meeting be cancelled and re-scheduled to September 19, 2005.

Moved by Councillor Johnston, seconded by Councillor Frew that the resolution(s) as approved by Council In Camera, be adopted.
